1. Agreement to Terms

By downloading, installing, or using JukeKaraoke ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Grant

2.1 Trial License

JukeKaraoke offers a 30-day free trial with full features. The trial begins when you first launch the Software and expires 30 days later.

2.2 Paid License

Upon purchase, you receive a perpetual, non-exclusive, non-transferable license to use JukeKaraoke on devices you own or control, subject to these terms.

2.3 License Tiers

• Basic License ($49): Personal, non-commercial use only. One installation per license.
• Professional License ($149): Commercial use allowed. Use at paid events, venues, or professional DJ services. Up to 3 installations per license.

3. Permitted Use

You may:

• Install and use the Software on devices you own
• Use the Software for DJ performances and karaoke events
• Create backups for personal use
• Use the Software commercially if you have a Professional license

4. Prohibited Use

You may NOT:

• Reverse engineer, decompile, or disassemble the Software
• Redistribute, sell, rent, or lease the Software
• Remove or modify any copyright notices
• Share your license key with others
• Use the Software for illegal purposes
• Use Basic license for commercial purposes
• Exceed the installation limit for your license tier

5. Music Licensing Responsibility

IMPORTANT: JukeKaraoke is software for playing music files YOU own or have legal right to use. You are solely responsible for:

• Obtaining proper licenses to play copyrighted music publicly (BMI, ASCAP, SESAC)
• Complying with copyright laws in your jurisdiction
• Obtaining venue performance licenses for commercial use
• Ensuring you have legal right to all music files used

Gain Publications is not responsible for any copyright infringement resulting from your use of the Software.

6. Intellectual Property

JukeKaraoke and all related materials are owned by Gain Publications and protected by copyright, trademark, and other intellectual property laws. Your license does not grant you ownership of the Software.

7. Updates and Modifications

We may provide updates to JukeKaraoke. Updates may:

• Add new features
• Fix bugs and security issues
• Modify or remove features
• Change system requirements

Paid license holders receive free updates for the version purchased. Major version upgrades (v1 to v2) may require additional purchase.

8. Privacy and Data

Use of JukeKaraoke is subject to our Privacy Policy. By using the Software, you consent to data practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Gain Publications shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the license
• We are not liable for data loss, equipment damage, or business interruption
• We are not liable for copyright infringement resulting from your use

11. Refund Policy

Refunds are handled according to Microsoft Store policies if purchased through the Store. For direct purchases:

• 30-day money-back guarantee if the Software fails to work as described
• Refund requests must include description of the issue
• No refunds after 30 days from purchase
• Refunds not available if license was shared or violated terms

12. Termination

This license is effective until terminated. Your rights terminate automatically if you:

• Violate any terms of this agreement
• Share your license key
• Use the Software for illegal purposes

Upon termination, you must uninstall and destroy all copies of the Software.

13. Third-Party Components

JukeKaraoke includes third-party open-source components:

• NAudio (MIT License)
• TagLibSharp (LGPL)
• RubberBand Audio Time Stretcher (GPL v2)
• Other components as listed in About → Licenses

These components are licensed under their respective terms. See in-app license viewer for details.

14. Export Control

The Software may be subject to export control laws. You agree to comply with all applicable export and import laws when using or transferring the Software.

15. Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Your Jurisdiction].

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

17. Changes to Terms

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gain Publications regarding JukeKaraoke.
